CMA's REVIEW OF CIRCLE/BMI UNDERTAKINGS
On 2 August 2021, the CMA announced that it is to review, at the parties' request, undertakings, given by Circle to the CMA on 17 April 2020 and accepted on 23 June 2020. Pursuant these undertakings, Circle agreed to divest Circle Hospital (Bath) Limited and Circle Birmingham Limited to a purchaser or purchasers approved by the CMA.
On 1 June 2021, Circle completed the divestment of Circle Hospital Bath to Royal United Hospitals Bath NHS Foundation Trust. However, Circle was not able to divest Circle Birmingham Limited.
On 21 June 2021, Circle wrote to the CMA requesting a variation of the UILs relating to the divestment of Circle Birmingham Limited, in light of a change of circumstances.
